If any manufacture and sale of adulterated drug leads to death or grievous hurt then minimum of 10 years of life Imprisonment and not less than ₹10 lakh fine or three times the market value of the confiscated drug which may be higher shall be the punishment. ‘
If death is the result of the usage of such drugs, the amount of the fine collected from the offender is given to the relatives of the deceased as compensation.
Non-Disclosure and Record-Keeping: Failure to disclose information of the manufacturer can lead up to the imprisonment for a term which may extend to 1 year or with fine of not less than 20,000 rupees or with both. Failure to maintain adequate documents can result in imprisonment for up to one year, or a fine of ₹1,000, or both.
