WHAT IS DIGITAL SIGNATURE (DSC)?

A Digital Signature Certificate(DSC) is the digital equivalent of a handwritten signature and can be obtained from a licensed Certifying Authority (CA). A DSC is a legal requirement for electronically signed documents under the Information Technology Act, 2000, and verifies the signer’s identity in electronic transactions as well as the integrity of the signed documents.

Types / Classes of Digital Signature Certificates

In India, DSCs are also distinguished by different levels of security and verification. The different types are:

1. Class 1 DSC

Has the lowest level of security, and only does name and email address verification with a database
Used infrequently when someone is making statutory filings.
Most of the time, MCA filing and GST e‑signature do not accept these.

2. Class 2 DSC (historically / now largely deprecated)

Verifies identities against a pre-verified database, such as PAN, Aadhaar, etc.
Used to be accepted for MCA, GST, and income tax filings.
Class 2 would be used less as time goes by since it is accepted less now and most statutory filing systems would prefer to use Class 3 DSC.

3. Class 3 DSC

Has the most security and needs intense verification, either face-to-face or via video conference.
Is necessary for most MCA filing, GST e‑signature, e-tenders, import-export portals, and government contracts.
Needs to be kept in approved cryptographic hardware tokens (USB, smart card)

4. DGFT DSC (DGFT / IEC‑specific DSC)

For trade with foreign countries, DGFT portal requires a certain DSC type.
Trade/export domain Class 3 DSC functionalities.

5. Document Signer DSC / Organizational DSC

Used by organizations to sign and automate a large number of documents.

DSC RENEWAL & VALIDITY

3 year validity periods are at the discretion of Certifying Authorities (CAs) and their policies as well as regulatory permissions.
Once a DSC expires, it may no longer be used for statutory filings or e-sign operations.

Renewal Process

To release an updated Digital Signature Certificate(DSC), it is mandatory for the client to complete digital signature renewal for continuous compliance to be upheld.

1. Login to the CA's portal as you did for signing DSC Documents.

2. Enter the details of your DSC including the serial number, class, and other details.

3. Complete the updated KYC either by video or by the paper KYC.

4. Pay the renewal fees and you are done.

5. Pay and you will either get the renewed Digital Signature Certificate(DSC) or it will be sent to you after your updated USB token.

6. If needed, re‑associate your renewed DSC with MCA, GST, or other relevant portals.

Best practice: start renewal 15 – 30 days ahead of time to avoid downtime during compliance periods. Having a DSC that is expired could create issues with your MCA filing or GST e‑signature activities.

Once you renew, you often have to re-register the DSC on the portals where you initially linked it, like the MCA portal. You may also need to unlink and re-associate it with your account before it can be used again.

MCA & GST E-FILING RULES

DSC and MCA Filing

Any company or LLP that is submitting e-forms through the MCA portal (MCA V3) has to sign it with a valid DSC.

If a DSC is not registered, e-forms signed with it may be technically valid, but will be rejected.

If the DSC expires during the GST compliance window, returns and amendments will not be accepted until the DSC is replaced or renewed.

Use the operating systems, browsers, and signing utilities (like emSigner) recommended by the portals.
Always keep a backup of your DSC token or certificate. But don’t ever give away the private key, and keep it locked up.
If things expire. upset DSC, or get your DSC away from coupled, maid easily, or don’t finish them. Snap filers.
Keep a signed log of DSC issue and renew, completion responsibility, and document usage as part of audit.
